Graves affirmed in his testimony that he never did anything to stop Weiss from pursuing charges in DC on his own.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_C51F18AA-FF6A-DFF7-100F-28FEB5CFDCC3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      This new testimony discredits claims made by two IRS whistleblowers that House Republicans have used to fuel an impeachment inquiry into President Joe Biden.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_55F666AD-8A89-DE92-45FB-28FEB5CF1A07@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Graves is the latest federal official whose congressional testimony undercuts specific claims by Gary Shapley and Joseph Ziegler, two IRS agents who came forward earlier this year with allegations that they witnessed political interference in the federal criminal investigation into Hunter Biden\u2019s taxes.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_692D5911-4ED7-A894-8252-28FEB5CF26B6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Last month, testimony from a number of FBI and IRS officials cast doubt on key allegations by Shapley and Ziegler, including that Weiss had claimed that he lacked authority to bring charges against the president\u2019s son and that he had been denied a request for special counsel status by Justice Department officials. Weiss has denied both those allegations.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_009AD0BF-0F04-F323-4A21-28FEB5DFF7E0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      According to a transcript of Graves\u2019 testimony, Weiss called Graves in early 2022 and said he wanted to bring charges against Hunter Biden in DC. Graves offered Weiss a \u201chigh-level commitment that we would provide whatever logistical support that he needed\u201d and said his team would explore joining the case.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_80891AFF-2283-EFDD-5E38-29329B81312D@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cIt was just assumed that, from the moment I got on the call, he was gonna be able to do whatever he needed to do in our jurisdiction to bring the case, if that was his prerogative,\u201d Graves said, rejecting claims that he stymied Weiss\u2019 ability to file charges.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_B7899EBC-F9F1-9087-10EF-28FEB5E0A488@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Career prosecutors from Graves office then conferred with Weiss\u2019 team and looked into setting Weiss up with a DC-based federal grand jury where he could seek an indictment against the president\u2019s son, according to his testimony.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_3530060D-F7D8-73DA-E2CD-28FEB5E04362@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Graves\u2019 team later decided they didn\u2019t want to jointly prosecute the case in DC, but that they would continue \u201cto provide all assistance that was necessary for (Weiss) to do whatever they wanted to do in our jurisdiction,\u201d Graves told the House Judiciary Committee.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_9C8EE477-674D-B0E5-E962-28FEB5E064FF@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Graves said it is \u201cexceedingly rare\u201d for a US attorney to join as a partner for an ongoing investigation in its final stages. Despite this, Graves told the committee it was his idea to initially bring up the idea of partnering to Weiss.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_1FA27542-6901-F34B-B9C3-28FEB5E06580@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The whistleblowers and other DOJ witnesses have testified that they believed Graves\u2019 refusal to partner with Weiss essentially blocked him from charging Hunter Biden in DC. The IRS whistleblowers \u2013 and by extension, House Republicans \u2013 have used that testimony to suggest that Weiss did not have ultimate authority over the criminal probe, and that Justice Department leadership was improperly protecting the Bidens.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_7CED2CC4-6C77-B608-0E8E-290358F8339A@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Republicans put that narrative front and center at their first impeachment hearing last month.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_6A30BA82-515A-E069-02B8-28FEB5E0B271@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      However, from Graves\u2019 perspective, his decision not to partner with Weiss had no bearing on whether Weiss could seek an indictment in the DC jurisdiction if he wanted. Other key FBI and IRS witnesses have also disputed some of the whistleblowers\u2019 related claims in their own private depositions.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_6A42CE52-8E28-184C-E752-28FEB5E05285@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cBased on what I know was occurring at that time in terms of what we were facilitating, there is no doubt in my mind that they understood they could bring whatever charges they wanted in the District (of Columbia),\u201d Graves testified.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_42CD2B81-6F0F-B5D5-9A94-28FEB5E01E6A@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The tax investigation into Hunter Biden is ongoing, and Weiss has said he\u2019s considering an indictment in DC or California. Weiss separately charged Hunter Biden in Delaware with three gun felonies tied to a revolver he purchased in 2018. He pleaded not guilty.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_C4D48EB1-2F02-C956-4527-28FEB5E09641@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      CNN has reached out to Weiss and Graves for comment.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_A4D0BC19-E3A7-973C-025F-28FEB5E0A3BF@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Shapley and Ziegler \u2013 the IRS whistleblowers who helped run the Hunter Biden criminal probe \u2013 went public months ago with allegations that Weiss was blocked from indicting Hunter Biden in DC and California, even though they and career Justice Department prosecutors recommended charging him with several felony tax crimes.\n  <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/image\/instances\/image-ea31c41e8568d96bdf2a0a402458cc74@published\" class=\"image image__hide-placeholder\" data-image-variation=\"image\" data-name=\"02 house oversight committee IRS whistleblowers 071923 SCREENGRAB\" data-component-name=\"image\" data-observe-re data-breakpoints=\"{\" image--eq-extra-small=\"\" data-original-ratio=\"0.5625\" data-original-height=\"1080\" data-original-width=\"1920\" data-url=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/230719130739-02-house-oversight-committee-irs-whistleblowers-071923-screengrab.jpg?c=original\" data-editable=\"settings\">\n<div class=\"image__container \" data-image-variation=\"image\" data-breakpoints=\"{\" image--eq-extra-small=\"\">\n       <picture class=\"image__picture\"><source height=\"720\" width=\"1280\" media=\"(min-width: 1280px)\"  type=\"image\/webp\"><source height=\"540\" width=\"960\" media=\"(min-width: 960px)\"  type=\"image\/webp\"><source height=\"270\" width=\"480\" media=\"(-webkit-min-device-pixel-ratio: 2)\"  type=\"image\/webp\"><\/source><\/source><\/source><\/picture>\n    <\/div>\n<\/div>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_53A0903B-FBF5-96B7-AD5E-28FEB5F1FE89@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Weiss, Graves, and the US attorney in Los Angeles, Martin Estrada, all swiftly denied this allegation in public statements. Graves is the first to deny it under oath to Congress, though House Republicans are pursuing interviews with the other two senior officials.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_52671DEB-4178-58D1-92DF-28FEB5F3C4F0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In addition to Graves\u2019 new revelations, previous testimony from a number of FBI and IRS officials has already cast doubt on some of the whistleblowers\u2019 key claims that there was political interference, including by Biden appointees, in the federal criminal investigation of Hunter Biden\u2019s taxes.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_3A676264-0F41-096D-2A5A-28FEB5F63350@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Both Graves and Estrada were appointed to their posts by Biden and confirmed by the Senate with bipartisan backing. Weiss was appointed by former President Donald Trump to be the US attorney for Delaware, and he opened the Hunter Biden probe in 2018. Attorney General Merrick Garland gave Weiss special counsel status in August.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_A5EF01E3-8D4C-C051-922A-28FEB5F8FC24@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Republicans pointed to Graves\u2019 Democratic political affiliation and the fact that he donated money to the Biden campaign to suggest he had a conflict of interest on the Hunter Biden criminal case. In his deposition, Graves maintained, \u201cI don\u2019t see it that way\u201d and argued he did not need to recuse himself.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_E6FDD8CD-8879-F72B-1E57-28FF6E9C7FB6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      He further disputed the IRS whistleblowers\u2019 version of events, saying there wasn\u2019t a question of whether Weiss could indict Hunter Biden in DC, but rather, \u201cthe only issue was whether we were going to seek to join their investigation or not,\u201d according to the transcript.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_DB67DA96-05FE-3966-883C-28FEB5FDCFA2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Graves said that while he was only familiar with the whistleblowers\u2019 through press reports, he framed their allegations as being based on \u201csecond or thirdhand\u201d information and argued that in a large institution like DOJ there are \u201cgarbles that can occur when there are communications across different components and people aren\u2019t talking directly to each other.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_10D120AE-0E32-F4ED-CA6C-28FEB6000CD4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The Hunter Biden tax probe revolves around nearly $2 million in taxes that he didn\u2019t pay on time, despite having the funds and being warned by his accountants, according to court filings. He owed the taxes after making millions of dollars overseas, including in China and Ukraine \u2013 deals that are now at the heart of the GOP impeachment inquiry.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_F54837B7-4AF2-8CB3-D399-28FEB60388D0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Hunter Biden eventually paid the tax bill in full, along with penalties and interest, with help from a wealthy friend, according to court filings and CNN reporting.
