\n A battle is quietly brewing between Texas Republican Gov. Greg Abbott and the Biden\u00a0administration over the state\u2019s deployment of razor wire at its border with neighboring New Mexico \u2013 its latest effort to curb illegal immigration on federal land without a permit.\n <\/p>\n

\n The\u00a0International Boundary and Water Commission,\u00a0which\u00a0administers the boundary and water treaties between the US and Mexico, told the Texas National Guard\u00a0earlier this month that it is \u201cencroaching on federal property\u201d and that such activity could \u201clead to violations of federal laws, international agreements, and hydraulic issues within the flood plain\u201d of the Rio Grande, according to an email first obtained by CNN.\n <\/p>\n

\n According to the\u00a0IBWC, an international body made up of a Mexican section and a US section headquartered in El Paso, Texas, the \u201cencroachment\u201d is on federal property in Texas that includes the floodplain of the Rio Grande, north of the US-Mexico border stopping just shy of the New Mexico state boundary line.\n <\/p>\n

\n While the IBWC did not describe the \u201cencroachment\u201d as razor wire in its letter,\u00a0New Mexico Democratic Rep. Gabe Vasquez told CNN his office was the first to speak with the IBWC and inform them that concertina wire had been installed on Texas\u2019 side of the Rio Grande. It was installed, he said, \u201cwithout the knowledge or approval of the IBWC, (his) office or local New Mexico officials.\u201d\n <\/p>\n

\n \u201cThis barrier is both unamerican and unconstitutional and needs to be removed immediately,\u201d Vasquez, who toured the area on Monday, said in a statement.\n <\/p>\n

\n The Rio Grande falls under multiple boundary and water treaties between the US and Mexico, and IBWC applies the rights and obligations assumed by the countries for the benefits of the people on both sides of the border. Those rights and obligations include the distribution of water and the preservation of the river. \u201cAll projects within the floodplain,\u201d according to IBWC, \u201crequire close coordination with Mexico as part of an international treaty that effects water deflection during water flowing events.\u201d\n <\/p>\n

\n \u201cI am kindly requesting that you immediately coordinate all your endeavors through this channel and refrain from any further activity that encroaches on federal property,\u201d IBWC said in\u00a0the October 11 email\u00a0to the state of Texas.\n <\/p>\n

\n Abbott\u00a0confirmed deployment of\u00a0a barrier\u00a0last\u00a0month during a\u00a0speaking engagement\u00a0in New York, when he said Texas was not only \u201cbuilding border barriers between the border of Texas and Mexico\u201d but also building \u201cborder barriers between Texas and New Mexico.\u201d\n <\/p>\n

\n \u201cMost of the people coming into the El Paso [Border Patrol] Sector, they don\u2019t come to the United States through Texas, they come through New Mexico and then go over to El Paso,\u201d Abbott\u00a0claimed,\u00a0without providing additional\u00a0details.\n <\/p>\n

\n CNN has reached out to Abbott\u2019s office and New Mexico Gov.\u00a0Michelle Lujan Grisham for comment.\n <\/p>\n

\n Vasquez\u00a0penned a letter\u00a0to Abbott\u00a0last week\u00a0denouncing the construction of the border barrier between Texas and his home state and demanded its removal. \u201cI call for the immediate removal of this barrier and urge you to work with Congress on real solutions to protect Americans,\u201d he wrote.\n <\/p>\n

\n IBWC\u2019s email\u00a0also\u00a0asks the state of Texas to comply with seven requirements, including a \u201cletter of application\u201d requesting a permit and advises that all projects within the Rio Grande\u2019s floodplain require close coordination with Mexico in compliance with international treaties. As of\u00a0Tuesday, Texas had\u00a0not complied with IBWC\u2019s request, according to\u00a0IBWC spokesperson Frank Fisher.\n <\/p>\n

\n CNN has reached out to Mexico\u2019s Foreign Ministry\u00a0and the US Justice Department\u00a0for comment.\u00a0The Justice Department referred CNN to the Department of Homeland Security.\n <\/p>\n

\n The border dispute is the latest quarrel between Texas and the Biden\u00a0administration, at a time when increased migration is straining state and federal resources.\n <\/p>\n

\n Abbott launched Operation Lone Star in March of 2021 to fight illegal immigration and has since deployed miles of border barriers along the Rio Grande between Texas and Mexico.\n <\/p>\n

\n In July, the Justice Department sued Texas claiming it unlawfully installed border buoys on the Rio Grande, and asked a judge to force the state to remove them. While a district court judge ordered their removal last month, the 5th US Circuit Court of Appeals has allowed them to remain in place while it considers the case.\n <\/p>\n<\/p><\/div>\n
