James Comer\u00a0released a video\u00a0raising questions about a 2018 personal check to Joe Biden from his brother James Biden and James\u2019 wife Sara Biden, which had the words \u201cloan repayment\u201d written on the front. Comer said he would view the $200,000 check to Joe Biden as \u201ctroubling\u201d even if it was a loan repayment, since it came on the same day that James Biden received $200,000 from a struggling health company he did\u00a0business with.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker80006356ibxur1pdi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Then Comer went further.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker80007356icn49u3zg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In a series of interviews with conservative media outlets, Comer, a Republican, repeatedly\u00a0said\u00a0he\u00a0did\u00a0not \u201cbelieve\u201d that Joe Biden had actually made a loan to his brother. And when\u00a0Democratic members of the committee and a lawyer for James Biden said that Comer\u2019s committee has documents that show there had indeed been a $200,000 loan from Joe Biden to James Biden, less than two months prior to the $200,000 check from James Biden and his wife to Joe Biden that said \u201cloan repayment,\u201d Comer declared\u00a0that the Democrats were \u201clying\u201d \u2013 saying that \u201cat the end of the day, there\u2019s no document that shows there was a loan.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker80008356ijrw6rlci@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      But banking records reviewed by CNN, which Comer\u2019s committee possesses, provide substantial evidence in support of the Democrats\u2019 assertions that there was indeed a $200,000 loan from Joe Biden to James Biden less than two months before the James Biden \u201cloan repayment\u201d check to Joe Biden for the same amount.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker80009356ig1of5stq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The evidence CNN has reviewed is almost certainly only a fraction of the evidence Comer\u2019s Republican-controlled committee has obtained, given that the committee subpoenaed years of financial records; the fraction CNN has seen does not prove with absolute certainty that there was a loan. But even this small batch\u00a0of evidence clearly shows that the Democrats have documents at least partially substantiating their assertions about the check \u2013 and that Comer has not yet released some documents that undercut his efforts to raise public suspicions about the Bidens.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker8000a356isdtq9jmy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      <strong>What the evidence shows<\/strong>\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker8000b356i754hf89l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      A source with direct access to the documents Comer\u2019s committee has obtained via subpoena provided CNN with copies of some of the James Biden banking records the committee obtained as part of its broader investigation into the finances of members of the president\u2019s family.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker8000c356i908mu3un@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Comer\u2019s team does not dispute that these banking records show that James Biden was sent a $200,000 wire transfer on January 12, 2018, less than two months before James Biden and Sara Biden wrote Joe Biden the March 1, 2018, \u201cloan repayment\u201d check for $200,000.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000d356ikw0xozzp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      So why, given the matching amounts and the \u201cloan repayment\u201d text on the check,\u00a0does Comer not \u201cbelieve\u201d that Joe Biden ever made the loan?\u00a0A Republican aide on Comer\u2019s committee\u00a0argued to CNN that there are reasons for doubt that the $200,000 wire transfer to James Biden was actually from Joe Biden.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000e356instkd0ye@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      We\u2019ll get into the aide\u2019s arguments later in this article. But the evidence reviewed by CNN supports Democrats\u2019 assertions that Joe Biden was the person behind the $200,000 wire transfer to his brother.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000f356i7dgjwqg8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Here\u2019s why.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000g356ixfbno8gj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The banking records reviewed by CNN show that the $200,000 wire transfer was sent from an attorney trust account (an account used by a lawyer to hold a client\u2019s money) at a Wilmington, Delaware, law firm that\u00a0Joe Biden co-founded\u00a0decades ago and that still has his\u00a0longtime friend\u00a0Melvyn Monzack as a partner.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000h356i715elxed@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The banking records reviewed by CNN do not show Joe Biden\u2019s name anywhere on the wire transfer. But Comer\u2019s committee possesses an additional piece of evidence that appears to clearly link Joe Biden to the attorney trust account the wire was from.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000i356idddbuzkq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The evidence is a copy of\u00a0another check, for $40,000, that was written by James Biden and his wife to Joe Biden in September 2017. On the back of that check, there is handwriting \u2013 with the president\u2019s name Joseph R. Biden Jr., then a\u00a0notation identifying Melvyn Monzack as Biden\u2019s\u00a0attorney-in-fact\u00a0(which generally means a person who has been granted the right to act on behalf of someone else), then a stamp saying the money was deposited in an attorney trust account with a particular account number.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000j356ixctnkhyr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Though that account number was partially redacted by the source for privacy reasons, CNN was permitted to view four digits. Here\u2019s the key:\u00a0<em>those four digits<\/em>\u00a0<em>are the same as four digits on the account that sent the $200,000 wire transfer to James Biden in early 2018<\/em>.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000k356igjh8kc5l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In other words, the evidence suggests that the $200,000 that was sent to James Biden in January 2018 came from an account that belonged to Joe Biden.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000l356iedh1ejdp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      In a\u00a0letter\u00a0to Comer on Thursday, the top Democrat on the committee, Rep. Jamie Raskin, wrote that\u00a0there is \u201cclear evidence that this transaction was a short-term, interest-free loan between brothers, which occurred while President Biden was also a private citizen.\u201d (Joe Biden was neither a government official nor a political candidate in 2018.)\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000m356i7p49dbyy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Raskin wrote that \u201cthe bank records provided to the Committee clearly show that President Biden had $200,000 wired to his brother on January 12, 2018. Despite this clear evidence that James Biden received a loan from his brother on January 12, 2018, and paid him back 48 days later with a check for the same amount marked \u2018loan repayment,\u2019 you continue to misrepresent the facts.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000n356inks3wfhf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Comer has made other points. He has emphasized that on the same day that James Biden wrote the $200,000 check to Joe Biden, James Biden received $200,000 from Americore Health, a\u00a0financially troubled firm with which he had a business relationship; Comer has accused James Biden of engaging in \u201cshady influence peddling\u201d\u00a0trading on the Biden name. But Comer has presented no evidence that Joe Biden was involved in his brother\u2019s transactions with the company, let alone that Joe Biden undertook any official acts during his vice presidency or presidency to benefit his brother.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000o356ia62r8c3n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      James Biden has not been charged with any offense, and his lawyer Paul Fishman said in an email: \u201cAt no time did Jim involve his brother in any of his business relationships.\u201d White House spokesperson Ian Sams said in an email that Comer\u2019s committee has \u201cagain turned up zero evidence of wrongdoing by President Biden \u2013 and that\u2019s because there is none.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeuker9000p356ib7kprdv1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      <strong>The response from Comer\u2019s committee<\/strong>\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeukera000q356i7snmx7mh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Last week, CNN sent an explanation of the evidence outlined in this article to an aide for the Republican majority on Comer\u2019s committee. The aide responded by making a detailed argument that it remains unclear that Joe Biden was the one who sent the $200,000 to James Biden in January 2018.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeukera000r356i8z062cob@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Again, CNN can\u2019t say with complete certainty that there was a loan. But there are significant holes in the aide\u2019s argument. Let\u2019s walk through them.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeukera000s356ils7i972j@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The Republican committee aide said that the attorney trust account number on the back of the 2017 check to Joe Biden is illegible except for the last two digits. Again, CNN has seen four digits, including those last two, that match four digits on the 2018 wire transfer to James Biden.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeukera000t356i42p0up0q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The Republican committee aide also said that other members of the Biden family have had dealings with Monzack\u2019s Delaware law firm, and that the banking records the committee possesses don\u2019t make clear that the attorney trust account number is Joe Biden\u2019s \u2013 \u201crather than a more generic account the firm could have used to mask the true identity of client transactions.\u201d But the committee has provided zero indication that Monzack somehow deceptively used this account or that the account was used to hold money for anyone other than Joe Biden. (Monzack didn\u2019t respond to voicemail messages requesting comment.)\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeukera000u356iqlo6udwf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Next, the aide said that Joe Biden deposited the $200,000 check from his brother in a different bank account, not the attorney trust account. But that\u2019s irrelevant to the question of whether the attorney trust account is his. Many Americans have more than one bank account. Joe Biden depositing a\u00a0check into a second account doesn\u2019t show that he isn\u2019t tied to the first account.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloeukera000v356ili2zwe67@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      On Thursday, Comer\u00a0issued a letter\u00a0to the White House calling for the release\u00a0of\u00a0any documents about the loan, such as a loan agreement, \u201cif\u201d there was indeed a loan; Comer also reiterated his position that \u201cno records in the Committee\u2019s possession state that Joe Biden made a large loan payment to his brother.\u201d\u00a0On Monday, Raskin issued a letter to Comer again accusing the chairman of misrepresenting the facts and again saying the bank records clearly show Joe Biden had made a $200,000 loan.\n  <\/p>\n<p class=\"paragraph paragraph_contributors inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cloev6zl200013b6ihebqwyz0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      CNN\u2019s Marshall Cohen contributed to this report.\n  <\/p>\n<\/p><\/div>\n<p>Read the full article <a href=\"https:\/\/www.cnn.com\/2023\/10\/31\/politics\/fact-check-evidence-supports-democrats-case-that-joe-biden-made-a-personal-loan-to-his-brother\/index.html\" target=\"_blank\" rel=\"noopener\">here<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On October 20, House Oversight Committee chairman Rep.
