Matt Gaetz confirmed he was the target when he played the threatening voicemail at the heart of the case on his podcast earlier this year. CNN has reached out to the Florida Republican\u2019s office for comment.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_2B49BA48-C8C9-6630-76DE-26277990354C@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      The defendant, 24-year-old Allan Poller, faces up to five years in prison when he is sentenced in January.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_15EF4BF7-7063-D972-463C-2627799DB5C5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      According to court documents, Poller, who is a student at Keene State College in New Hampshire, placed a call to the Washington, DC, office of an unnamed member of Congress just after midnight on March 29.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_4E0B004B-495D-8A56-71D7-262779AADC4D@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      No one in the office answered, prosecutors said, so Poller left a voicemail warning the member to stop \u201ccoming for the gays\u201d and threatened to kill the member should they continue.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_54D9AAD6-EA0F-9939-762A-262779B2781B@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cIf you keep on coming for the gays, we\u2019re gonna strike back and I guarantee you, you do not want to f**k with us,\u201d Poller said, according to court documents. \u201cWe will kill you if that\u2019s what it takes. I will take a bullet to your f**king head if you f**k with my rights anymore.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_F0997120-C1B9-A888-F4C2-262779C0BB83@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Poller later admitted to leaving the message in an interview with law enforcement, according to court documents, telling investigators that he had been drinking and become angry while watching videos on TikTok.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/paragraph_CC5E0FA5-1FB1-5C6E-4BB0-262779C90D65@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Poller\u2019s attorney Jesse Friedman said in a statement that his client \u201crecognizes that hate in any form is wrong and hurtful.
